BASIC PURPOSE:  To analyze and interpret state statutes and regulations and to determine procedures for resolving legal and legislative issues affecting state agencies.

 

CHARACTERISTIC DUTIES AND RESPONSIBILITIES:

 

·        Interprets state statutes and regulations and provides legal analysis and counsel concerning agency legal issues.

 

·        Monitors proposed legislation of bills with potential for agency impact and recommends appropriate course of legal action.

 

·        Resolves legislative problems and responds to legal inquires concerning agency objectives on policies from the public, legal professionals, advocacy groups, and state and federal officials.

 

·        Prepares cases and appears in court actions involving cases arising in the conduct of state affairs.

 

·        Prepares legal research papers and memoranda.

DISTINGUISHING FACTORS:

 

Skill:  Requires skill in recommending routine changes in standardized operating procedures OR in retrieving, compiling and reporting data according to established procedures OR in operating complex machines.

 

Knowledge:  Requires expertise in a highly specialized, technical or professional discipline to manage or create policy at a system wide administrative level.

 

Impact:  Requires responsibility for achieving major aspects of long-range agency objectives by planning short- and long-term organization goals, reviewing recommendations for procedural changes, and developing or revising program policies.  Errors at this level result in incorrect decisions at an administrative level, and are detected subsequent to implementation in an overall evaluation process.

 

Supervision:  Requires partial supervision of other employees doing work which is related or similar to the supervisor, including assigning job duties, providing training, giving instructions and checking work.

 

Working Conditions:  Requires performing regular job functions under good conditions in a safe working environment.

 

Physical Demands:  Requires light work, including continuous walking or operating simple equipment for extended periods of time as well as occasional strenuous activities such as reaching or bending.

 

Communication:  Requires acting as the official representative of the agency, including explaining and defending current and long-range goals or objectives which directly affect public policy decisions regarding major state programs and services.

 

 

 

Complexity:  Requires evaluating a combination of wide-ranging job functions to determine work procedures, to solve problems, and to reach conclusions by applying analytical, technical, or scientific thinking.  This level also requires planning policies and long-term strategies, drawing conclusions based on available criteria, and evaluating the effectiveness of program objectives.

 

Independent Action:  Requires independent judgment in planning and evaluating work procedures and in supervising the development of professional, technical and managerial standards under administrative direction and according to broad departmental guidelines.

 

MINIMUM QUALIFICATIONS:

 

Education:  J.D. from a recognized law school.

 

Experience:  Two years' experience in the practice of law.

 

License/Certification:  Valid driver’s license and/or access to transportation for statewide travel.

 

SPECIAL QUALIFICATIONS:  Must be an active member of the New Hampshire Bar Association and in Good Standing.

 

RECOMMENDED WORK TRAITS:  Knowledge of pertinent laws of trial, legal procedures, and methods of legal research.  Ability to prepare legal cases and briefs and to represent an agency in court proceedings.  Ability to render effective decisions and deal tactfully with the courts, local enforcement officials, state department heads and the public.  Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.
