BASIC PURPOSE:  To analyze and interpret state statutes and regulations and to draft proposed legislation for state departments and agencies.

 

CHARACTERISTIC DUTIES AND RESPONSIBILITIES:

 

·        Renders official opinions on state statutes as well as legal interpretations of agency rules and regulations.

 

·        Conducts legal research to provide analysis and counsel concerning legal issues at the agency level.

 

·        Drafts and evaluates pending legislation and counsels agencies regarding impact of legislative changes.

 

·        Plans legal seminars for town and city officials to explain changes in state statutes.

 

·        Prepares cases and appears in court actions involving cases arising in the conduct of state affairs.

DISTINGUISHING FACTORS:

 

Skill:  Requires skill in analyzing and interpreting data, policy and procedures OR in using equipment in order to arrive at logical conclusions or recommendations.

 

Knowledge:  Requires expertise in a highly specialized, technical or professional discipline to manage or create policy at a systemwide administrative level.

 

Impact:  Requires responsibility for achieving major aspects of long-range agency objectives by planning short- and long-term organization goals, reviewing recommendations for procedural changes, and developing or revising program policies.  Errors at this level result in incorrect decisions at an administrative level, and are detected subsequent to implementation in an overall evaluation process.

 

Supervision:  Requires partial supervision of other employees doing work which is related or similar to the supervisor, including assigning job duties, providing training, giving instructions and checking work.

 

Working Conditions:  Requires performing regular job functions under good conditions in a safe working environment.

 

Physical Demands:  Requires light work, including continuous walking or operating simple equipment for extended periods of time as well as occasional strenuous activities such as reaching or bending.

 

Communication:  Requires acting as the official representative of the agency, including explaining and defending current and long-range goals or objectives which directly affect public policy decisions regarding major state programs and services.

 

 

Complexity:  Requires evaluating a combination of wide-ranging job functions to determine work procedures, to solve problems, and to reach conclusions by applying analytical, technical, or scientific thinking.  This level also requires planning policies and long-term strategies, drawing conclusions based on available criteria, and evaluating the effectiveness of program objectives.

 

Independent Action:  Requires independent judgment in planning and evaluating work procedures and in supervising the development of professional, technical and managerial standards under administrative direction and according to broad departmental guidelines.

 

MINIMUM QUALIFICATIONS:

 

Education:  J.D. from a recognized law school.

 

Experience:  Four years' experience in active practice of law.

 

License/Certification:  Valid driver’s license and/or access to transportation for statewide travel.

 

SPECIAL QUALIFICATIONS:  Must be an active member of the New Hampshire Bar Association and in Good Standing.

 

RECOMMENDED WORK TRAITS:  Knowledge of judicial procedures and rules.  Knowledge of common, statutory and constitutional laws of the state.  Knowledge of court and legal procedures.  Ability to prepare legal pleadings, briefs and memoranda.  Ability to perform legal research.  Ability to render effective decisions and deal tactfully with the courts, law enforcement officials, state department heads and the public.  Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.
